there is no real defensible privacy for the patient. The HHS Office
for Civil Rights (OCR) received 22,664 complaints from April 2003
through Sept. 30, 2006. HHS decided that only 5,400 (23.8%) merited
further investigation or action, according to agency statistics.
Of the 5,400
complaints that were pursued, OCR took no effective action in 3,700
cases. Of the remaining 1,700, the Office of Civil Rights found that
the covered healthcare organization named in the complaint had not
actually violated the HIPAA privacy rule.
Health and Human
Services did not find a single case where the doctor’s practices
violated the patient’s privacy rights. Since this is statistically
impossible it is clear that the Office for Civil Rights is being
driven by the medical lobby.
American doctors
and their lobbyists could not have done of better job of influencing
Health and Human Services if they had written the HIPAA privacy rule
themselves.
These new computerized medical record systems
(EMR) are not as secure as the old fashioned legacy paper based
patient medical charts. Osama Bin Laden hiding in a cave in
Afghanistan could easily hack into or pay a disgruntled employee for
the online credentials to steal your medical information. It is much
harder for dishonest individuals to steal your medical information
from a legacy paper based chart system because they would have to
risk being shot by police and arrested for numerous felonies for
breaking into a doctor’s brick and mortar office reminiscent of
Watergate.
Doctors
typically share their online credentials with their medical
assistants, office managers, billing clerks and even their
receptionists. Doctors should be held accountable as they are
responsible for safeguarding your sensitive medical information.
These new
computerized medical record systems have been manipulated so that
auditing who is accessing and reviewing your electronic medical
files is virtually impossible.
The HIPAA waiver
should be removed to eliminate the possibility of patients being
unwitting deceived by clever defense attorneys into waiving their
important medical privacy rights when they are establishing care or
during treatment.
Accessing
medical records without informed consent should be criminalized into
federal law. Appropriate sanctions should include a $250,000 fine
and a five year prison term per infraction for doctors, medical
assistants, office managers, hospitals, defense attorneys, insurance
companies, private investigators and other individuals who willfully
violate the patient’s medical privacy rights.
A new federal
cause of action should be created allowing the injured patients to
sue in federal court for money damages, attorney’s fees and punitive
damages against doctors, medical assistants, office managers,
hospitals, defense attorneys, insurance companies, private
investigators and others who violated the patient’s medical privacy
rights.
Medical privacy
rights without the appropriate enforcement sanctions are a waste of
the taxpayer’s time and money. Can’t decide if you want to order a
pizza or call for an ambulance?
In 2008 over one
million people took the oath of allegiance becoming United States
Citizens. They consisted of Mexicans, Indians, Filipinos, Chinese,
Cubans and Vietnamese. At this rate America will have at least
twenty million new American citizens within the next twenty years.
This is not counting the offspring that will no doubt be created by
these new American citizens.
Apparently the
new citizens from Mexico, India, Philippines, China, Cuba and Viet
Nam are the replacements for the millions of American senior
citizens who are no longer considered contributing members of
society. We suggest they limit the ages of new immigrants to
under forty years of age and with a college degree. That way they
can contribute to the American economy for at least twenty years
before claiming any benefits.
If the United
States is unable to perform a thorough criminal background check of
these new immigrants then the US Bureau of Citizenship and
Immigration Services should err on the side of caution and refuse
their entry into the United States.
With an
estimated American jail population approaching two million prisoners
we don’t need to import any new criminals. Governments’ intent on
freeing themselves from the extraordinary and unproductive expense
of feeding and housing large numbers of prisoners may falsely
certify that immigrants with a criminal background are good to go.
House Speaker
Nancy Pelosi and leaders of the Senate we respectfully suggest you
move decisively to cut off the head of the serpent by repealing the
insurance industry’s 64 year old anti trust exemption before the
serpent has an opportunity to coil it’s deadly body around you.
House of
Representatives Resolution HR 3962 was passed however the Senate
version of the Affordable Health Care for America Act must still
pass the Senate with the single Jewish Senator from Israel Joe
Lieberman having the power to derail Universal Health Care in this
predominantly Gentile country.
The United States House of Representatives and
the Senate have been struggling to find a way to pay for the
Affordable Health Care for America Act.
While our staff admittedly
is not as smart as the army of college educated lawyers that
dominate Washington District of Columbia they dreamed this up over a
pot of coffee and a dozen Dunkin'
Donuts.
If the
Affordable Health Care for America Act passes the United States
Senate with an opt out option and your governors and representatives
decide to opt out we suggest you return the favor by opting them out
of office during the very next election.
Speaker of the House Nancy Pelosi this is your
chance to make history. If you have a conscious you probably realize
that the current health care bill that passed the house and the
senate is a legislative abomination.
The final Health
Care for America bill that comes out of the reconciliation process
must contain the public option and you must reinforce the new
Universal Health Care law by repealing the ridiculous anti trust
exemption that created this fiasco in the first place.
Failure Of
Speaker Nancy Pelosi to make these critical changes now to the
Affordable Health Care for America Act will most certainly doom the
Democratic Party to massive losses at the 2010 midterm elections.
Speaker Nancy Pelosi it is time to become a
modern day Joan of Arc by killing off the insurance industry once
and for all. Do it for the people not the greedy insurance industry
and their army of corrupt lobbyists. The actions that you take now
will forever write how history remembers you.
During the 2008 presidential election we all
heard big talk about change. Change you can believe in was the
slogan of the Democratic Party. Many of us very frustrated with the
constant war mongering of the Republican Party and the unwillingness
of the Republicans to have a compassionate heart were ready for a
change.
So here we are
with the current Democratic Administration completing one full year
in office. It’s time to review the past year and issue our 2010
Democratic Report Card.
During 2009 we
all witnessed corporate welfare on an unprecedented scale.
The current
Democratic Administration has bailed out automobile manufacturers
that refused to change. The current Democratic Administration has
bailed out the Wall Street Brokerage Houses that took incredibly
stupid risks. The current Democratic Administration has bailed out
the Mega Banks that continue to gouge the American public. The
current Democratic Administration has bailed out the largest
insurance company in America under the pretext of too big to fail.
Frankly I
preferred President George W Bush’s honest and candid response when
he was appraised of their situation. President Bush suggested that
they should be allowed to fail. I wholeheartedly agree with
President Bush. If any American business places incredibly stupid
bets at the Wall Street gambling table or refuses to adapt to change
they are demonstrating they don’t deserve to be in business.
Maybe it’s time
for a no party Direct Voting System where all United States citizens
cast their computerized votes from the privacy of their homes for
their representatives and on any financial legislation that costs
the American Taxpayer over ten million dollars.
With a properly
implemented Direct Voting System there would be No more Republicans
No more Democrats No more Independents and best of all No more lies.
This would be a
highly advanced computerized voting system with strict
authentication where any American Citizen that does not vote and
does not have a good verifiable reason would be subjected to fines
of at least $2,500.
The United States already has the Information
Processing infrastructure in place. We currently have an abundance
of experienced American born computer programmers many unemployed
and displaced by cheaper labor primarily from India. These seasoned
and unemployed American born Computer Programmers are the natural
choice to make the Direct Voting System a reality. Sorry India you
are going to have to sit this one out.
Imagine no more
lobbyists, back door deals, corporate greed and partisan politics
getting in the way of the true will of the people. We are so ready
for a new political system where there is absolutely nobody to bribe
or influence.
Imagine the huge
cost savings to the American taxpayers of being able to cut hundreds
of thousands and possibly millions of unnecessary overpaid patronage
related Federal Civil Service jobs and their related State Civil
Service jobs from the financial backs of the humble taxpayer.

Party to return the favor by designing a comprehensive high tech

Let us refresh
your memory on September 24, 1998 at 8:00 PM The U.S. House of
Representatives passed S 3736, the "Workforce Improvement and
Protection Act," by a vote of 288 to 133. This was a Republican
sponsored bill with the Republicans voting 189 YEA and only 34 NAY
with only five Republicans not voting. The Democrats voted 99 YEA
and 98 NAY with 9 Democrats not voting.
A more appropriate title for S 3736 would have
been the, “Discard American Workers and Hire Cheap Indian Labor
ACT”.
The Indian
population was estimated at 1,166,079,217 during July 2009 by the
Central Intelligence Agency. That is a tremendous amount of
potential H1B VISAS and It looks as thou our friends in India have
way too much time on their hands.
All that
American Companies have to do is claim that they are unable to hire
high technology workers and they are granted an H1B exemption.
A small time car wash operator only has to
claim that he can not find a competent American worker to push the
big red button and suddenly a chartered 747 is depositing 200 Indian
computer professionals at his front door.
The duty of the
American government is to take care of the needs of their citizens
first, not to try and curry favor with unfriendly foreign
governments.
If the
Republicans want to help foreign governments with a surplus of
workers they can solicit charitable contributions from their vast
network of disingenuous news outlets and sponsor massive airlifts of
condoms for the needy.
A nice college educated black man is working
two shifts at the local car wash to pay for the car of his dreams a
brand new Cadillac. This guy is a very hard working fellow that
enjoys a lot of face time with all the local television stations.
About two years
into the payments and feeling the ever pressing yoke of the new car
payment machine he is advised to purchase a second Cadillac.
Confused he asked his economic adviser how this would work as it
appears he would have twice as many car payments and twice as much
trouble.
His economic
adviser states confidently that he would be helping to stimulate the
economy. A noble fellow he agrees and purchases her the second
Cadillac. Six months later his economic adviser (his wife) leaves
him and runs off with a much younger man.
The moral here
is when somebody suggests that you can spend your way out of debt by
doubling or tripling your expenditures you should consider calling a
psychiatrist for them because this idea is as crazy as it sounds.
It is economic
insanity to think that you can actually spend your way out of debt
as all you are doing is getting on the fast track to economic
Armageddon.
If you want to
win the next election there is no easier way to do it then to create
several hundred thousand new civil service positions that will no
doubt be very grateful at the mid term elections.
What America
really needs is to improve the financial stability of the social
security trust fund by passing strict laws that prohibit any type of
borrowing from the social security trust fund for any reason other
then for social security.
Sorry defense
industry it’s time to create a backup plan.
We suggest you
convert your idle nuclear submarine manufacturing factories to
civilian use by producing high tech refrigerators. They look very
similar and are essentially made from the same materials. That way
you can convert them back if the need arises.
Since a loss of
manufacturing capacity is what really has led to the economic
collapse of the United States the idle and currently non productive
defense industry should seize this amazingly patriotic opportunity
to defend their country from the Chinese manufacturing machine.
Granted it will
be much harder for the defense industry to hide billions of dollars
in cost overruns in a $2,500 new technology refrigerator but it will
definitely teach them how to compete.
So what is the correct course of action to
take with Greece? Will the stock market completely collapse or the
world come to an catastrophic end if the United States does not
economically intervene?
We don’t think
so and we feel that it is a very big mistake to send the message
that the United States is going to bail out Greece or any other
incompetent over spending government.
America has its
own problems and we have not seen any body come to the aid of the
United States so no Greek rescue plan.
If our current
administration completely loses its mind and decides to bail out
Greece the American Taxpayers might as well bend over now and pass
the olive oil.
